Credit Reporting Policy and Statement of Notifiable Matters

For the purpose of this Credit Reporting Policy, Carzie Australia Pty Ltd, trading as Carzie (ABN 48 688 516 289, Australian Credit Representative No. 573586, and an authorised representative of Alpha Car Finance Pty Ltd, Australian Credit Licence 411447) and its related companies in Australia are referred to as we, us or our. The Privacy Act 1988 (Cth), the Australian Privacy Principles and the Privacy (Credit Reporting) Code 2014 govern the way we must manage your credit-related information. This policy describes the information we collect and hold, how we use and disclose it, how it is secured, and how you can access and correct it.

Collection of information

We may collect and hold credit-related information about you that is relevant to assessing your application for a lease and managing your lease. This includes credit information, credit eligibility information, CRB derived information and CP derived information (as those terms are defined in the Privacy Act).

Credit information is the information we may collect from and give to credit reporting bodies (CRBs), including Equifax, and includes: identity details; the fact that you have applied for credit, the type and amount; the fact that we are a credit provider to you; the identity of your other credit providers; consumer credit liability information; default and repayment history information; new arrangement information; publicly available information such as bankruptcy, insolvency and credit-related court judgements; and publicly available information relating to your credit worthiness.

Credit eligibility information is information that CRBs give us, such as a credit score, default information, repayment history information, credit inquiries, court proceedings information, personal insolvency information, and CRB derived information. CP derived information is information we derive ourselves, including our own assessment of your credit worthiness and a risk profile analysis.

Method of collection

Where possible, we collect credit-related information directly from you through our standard forms, via email, by telephone, in person, or via our website. We also collect it from credit reporting bodies, and in certain situations from another credit provider where permitted by the Privacy Act. We may also collect it from third parties acting on your behalf, such as financial advisors.

Purpose of collection

We collect and use your credit-related information to: assess your financial position and whether to offer you a lease; manage your lease; for internal management directly related to the management of credit (including assisting you to avoid defaults, collecting amounts owed, assigning debts, participating in the credit reporting system, and dealing with complaints); where we reasonably believe you have committed a serious credit infringement; and where otherwise required or permitted by law. If the information you provide is incomplete or inaccurate, we may be unable to assess your application and provide the goods and services you are seeking.

How we use and disclose your information

Our use and disclosure of credit-related information is governed by Part IIIA of the Privacy Act and the Credit Reporting Code. We may disclose credit-related information to: our workers, contractors and related companies, including Alpha Car Finance Pty Ltd; credit reporting bodies including Equifax; third parties who assist in processing your application or managing the lease; other credit providers with an Australian link; enforcement bodies; external dispute resolution providers; guarantors with an Australian link; debt collectors; third parties who assist us in operating our business; third parties to whom you have agreed; and as otherwise permitted and required by law. We currently disclose credit-related information to Equifax; if we disclose to other CRBs in future, we will update this policy.

You may request that Equifax does not use your credit reporting information for the purposes of pre-screening of direct marketing, or does not disclose your credit reporting information if you reasonably believe you have been, or are likely to be, a victim of fraud.

Overseas disclosures

We do not presently store credit-related information overseas, but we may disclose it to our service providers located overseas (including in the Philippines) and to credit reporting bodies who engage other parties overseas.

Security of information

We store your credit-related information in different ways, including in paper and electronic form. We take all reasonable measures to ensure it is stored safely to protect it from interference, misuse, loss, unauthorised access, modification or disclosure. Where information is no longer necessary, we delete or permanently de-identify it, subject to data retention laws.

Access and correction of information

You may access the credit-related information we hold about you by making a written request. We will respond within a reasonable period and, except where prohibited, may charge a reasonable fee for processing (but not for making) the request. We may decline a request in circumstances prescribed by the Privacy Act and will give written reasons. If you believe the information is inaccurate, incomplete or out of date, please notify us; we will take reasonable steps to correct it within 30 days (or another agreed time frame).

Complaints and feedback

If you have any queries or concerns, or wish to make a complaint about a breach of the Privacy Act, the APPs or the Credit Reporting Code, please contact us by email at compliance.manager@carzie.com.au, by telephone on 1300 036 397, or by post to GPO Box 1185, Brisbane City QLD 4001. We will respond within 30 days (or another agreed time frame).

If you are not satisfied with our response, you can submit a complaint to the Office of the Australian Information Commissioner at oaic.gov.au. Alternatively, you may contact our external dispute resolution scheme, the Australian Financial Complaints Authority (AFCA): website afca.org.au, email info@afca.org.au, telephone 1800 931 678 (free call), or in writing to Australian Financial Complaints Authority, GPO Box 3, Melbourne VIC 3001.

Statement of Notifiable Matters

Under the Credit Reporting Code, there are several notifiable matters we are required to disclose to you at or before the time of collecting personal information that is likely to be disclosed to a CRB:

  • the CRB may include the credit information we give it in reports provided to other credit providers to assess your credit worthiness;
  • if you commit a serious credit infringement, we may disclose this to a CRB;
  • you can request a copy of this Credit Reporting Policy from us or our website;
  • you can request a copy of Equifax's credit reporting policy from its website;
  • you have the right to access credit information we hold about you, request that we correct it, and make a complaint;
  • you can request a CRB not to use your credit reporting information for the purposes of pre-screening of direct marketing; and
  • you can request a CRB not to use or disclose your credit reporting information if you believe on reasonable grounds that you have been, or are likely to be, the victim of fraud.

You can ask us to give you a copy of this Credit Reporting Policy, including the Statement of Notifiable Matters, in a different form (for example, hard copy) and we will take reasonable steps to comply with that request.
